The Premier Brevet Grant Program

At Equinox, we are well aware of the most recent trends concerning intellectual property. To this effect, we would like to invite you to discover Premier Brevet (link in French only), a program aimed at simplifying the steps Quebec inventors must undertake to obtain their first patent.


The Program and its Objectives

The Premier Brevet program is offered by the Ministère de l'Économie, de l'Innovation et des Exportations. It aims to increase the number of Quebec companies seeking to protect their intellectual property assets. Namely, this government initiative intends to simplify the steps necessary for companies with fewer than 250 employees to obtain a patent.


Eligibility Criteria

To be eligible for the program, this must be the first time that the applicant company is applying for intellectual property protection rights under circumstances considered valid by the program.

The activities eligible for the Premier Brevet program are:

  • The preparation of opinions concerning registrability, infringement and the validity of Industrial Designs;
  • The creation of strategies aimed at protecting intellectual property;
  • Activities preparing the use of the invention (once the intellectual property rights have been obtained);
  • Patent applications, industrial design applications and or integrated circuit topographies in Canada and abroad;
  • Studies on certifications or on authorizations that are crucial for the use of products;
  • Research analyzing the state of the art currently covered by intellectual property rights (in Canada and abroad) before the filing of patent application, in order to validate the uniqueness of the innovation;
  • Only the Ministère de l'Économie, de l'Innovation et des Exportations is allowed to determine the eligibility of a company.

Here is an overview of expenses legitimately recognized by the program:

  • Purchasing fees for various documents (i.e., study reports);
  • Registration fees for industrial designs and integrated circuit topographies;
  • Fees associated with the protection of intellectual property;
  • Costs related to filing a patent application;
  • Professional honorariums paid for consultation services.




Government funding granted by the Premier Brevet program consists of a (non-refundable) contribution, which can reach half of the project’s eligible expenses.

As a result, the company wanting to file a request for funding must fill out the Premier Brevet program form and attach a service agreement with a professional, firm, or association working within the intellectual property rights sector.

Then, the company has to send the documents to the Direction des maillages et des partenariats industriels at the Ministère de l'Économie, de l'Innovation et des Exportations. It is also important to know that you cannot receive funding through the program more than once.
